Terms of Service

1. Acceptance of Terms

By accessing or using WFC360 software products, including WFC Control and WFC Verify (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Services on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

2. Description of Services

WFC360 provides cloud-based workforce management software including scheduling, live operations management, staff vetting and screening, HR management, training management, document management, supplier compliance, and related services.

3. Account Registration

To access the Services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorised access to any part of the Services or related systems
  • Transmit any viruses, malware, or other harmful code
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Use the Services to process data in violation of applicable data protection laws

5. Data Protection and Privacy

Your use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy. WFC360 processes personal data in accordance with the UK GDPR and the Data Protection Act 2018.

6. Intellectual Property

The Services and all content, features, and functionality thereof are owned by WFC360 and are protected by UK and international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Services for your internal business purposes.

7. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. WFC360 reserves the right to change pricing with 30 days' notice to existing customers.

8. Limitation of Liability

To the maximum extent permitted by applicable law, WFC360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Services.

9. Termination

Either party may terminate the agreement with 30 days' written notice. WFC360 may terminate immediately if you breach these Terms. Upon termination, your right to use the Services will cease and we will provide you with an export of your data for 30 days following termination.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
