WFC360 operates the website at wfc360.com and provides three software-as-a-service products: WFC Control (workforce scheduling), WFC Verify (BS7858 staff screening), and WFC Compliance (supplier compliance management) (collectively, the "Services").

2. Acceptance of Terms

By accessing or using the WFC360 website or any of our Services, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms on behalf of yourself or your organisation, and agree to comply with these Terms and all applicable laws and regulations.

3. Use of the Website

You agree to use the WFC360 website only for lawful purposes. You must not:

• Use the website in any way that violates applicable local, national, or international laws or regulations.

4. Software Services (SaaS)

Access to WFC Control, WFC Verify, and WFC Compliance is governed by a separate subscription agreement entered into at the time of sign-up. These Terms apply to your use of the website and any trial or demo access. The following provisions apply to all Services:

• Licence: Subject to payment of applicable fees, we grant you a limited, non-exclusive, non-transferable licence to access and use the Services for your internal business purposes.
• Restrictions: You may not resell, sublicense, reverse engineer, or create derivative works of any Service.
• Account security: You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Acceptable use: You must not use the Services to store or transmit unlawful content, infringe third-party rights, or interfere with the integrity or performance of the Services.

5. Intellectual Property

All content on the WFC360 website and within our Services — including text, graphics, logos, software, and trademarks — is owned by or licensed to ORM Systems UK Ltd and is protected by UK and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

You retain ownership of any data you upload to our Services ("Customer Data"). You grant us a limited licence to process Customer Data solely to provide the Services to you.

6. Privacy and Data Protection

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the processing of your personal data as described in the Privacy Policy.

Where you use our Services to process personal data of third parties (e.g. employees undergoing BS7858 screening), you are the data controller for that data and are responsible for ensuring you have a lawful basis for processing. We act as your data processor and will process such data only on your documented instructions.

The WFC360 website and Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the website or Services will be uninterrupted, error-free, or free of viruses or other harmful components. WFC360 does not provide legal advice; the Services are tools to assist with compliance processes and do not constitute legal or regulatory advice.

8. Limitation of Liability

To the fullest extent permitted by law, ORM Systems UK Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the website or Services.

Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the greater of (a) the total fees paid by you to WFC360 in the 12 months preceding the claim, or (b) £100.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

The WFC360 website may contain links to third-party websites. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.
